Formal and legal procedures

Electricity investments require the fulfilment of many criteria in terms of formal and legal aspects. Energy investment documentation 

The documentation of energy investments includes, among other things, the execution of analyses concerning the profitability of the investment. This stage allows assumptions to be verified and investment plans to be adjusted, if necessary, to the potential of the planned undertaking. A properly performed analysis also allows the costs of both the project and its realisation to be estimated, as well as its long-term benefits in the form of lowered electricity bills, for example in the case of RES installations.

The next stage of preparatory work within the formal and legal issues is the technical and environmental documentation. Many details of its preparation are contained in various laws or regulations. The preparation of such documentation requires not only experience and general knowledge, but also up-to-date knowledge of currently applicable laws and technical standards. Different types of investment 

Depending on the planned energy investment, different types of formal documents, approvals or permits may need to be obtained. Investment documentation for a new power line will differ in many areas from that needed for the construction of a wind power plant or a photovoltaic farm.

For example, RES project documentation should include elements such as:

  • verification of the area planned for the investment – in terms of location, nearby infrastructure, size of the area in relation to the planned investment
  • the local spatial development plan for the area with detailed information regarding the installation, its parameters, the impact of the investment on the environment

  • application for issuance of Development Conditions or application for enactment of the local spatial development plan

These are just some of the documentation and its parts that are necessary to obtain a construction permit for an energy project with regard to RES.

Other investments in energy infrastructure, such as the construction of lines, can also be carried out only after a number of formal and legal requirements have been met. In this case, it is necessary, for example, to prepare a design for the route of the power line. Once the route has been determined, an easement strip for the power line can be indicated and titles to the property can be obtained, an environmental decision applied for and then a location decision, local spatial plan and building permit obtained.
